Privacy Policy
General provisions
1.1. This Privacy Policy (hereinafter - the Policy) defines the procedure and grounds for processing personal data that the Entrepreneur* receives from a natural person - a user (hereinafter - the User/Participant) of the mobile application (hereinafter - the Application) and/or other services of the Entrepreneur's application software interface, which allow the User to register in the Application and receive the services of the Entrepreneur.
1.2. The basis for the processing of personal data collected by the Entrepreneur using the Application is the consent of the subject of personal data to the processing of his personal data.
The entrepreneur processes personal data of Users exclusively within the requirements of the Law of Ukraine "On the Protection of Personal Data".
1.3. The entrepreneur does not collect or process personal data about racial or ethnic origin, political and religious beliefs, membership in political parties and trade unions, and related information.
Scope of application
2.1. The owner of the database of personal data of Users who voluntarily downloaded the Application or used another tool to receive the services of the Entrepreneur online is FOP Tarasenko.
2.2. By using the services of the Entrepreneur through the application and/or other service of the application software interface, the User gives voluntary and unambiguous consent to the processing of his personal data by the Entrepreneur.
The scope of the User's personal data includes and/or may include the following information:
surname, first name;
passport data;
sex;
date and place of birth;
registration number of the taxpayer's registration card (identification number);
place of residence and/or registration;
personal phone numbers;
e-mail addresses;
correspondence delivery addresses;
IP address;
access time to the Application, etc.
2.3. Personal data processed by the Entrepreneur are confidential information.
Information collected, received and posted by the Entrepreneur
3.1. When the User creates an account in the application, the Entrepreneur may request the information listed in p. 2.2 of this Policy.
3.2. During the operation of the application, the Entrepreneur can collect personal information about the participation of Users in marketing campaigns organized by the Entrepreneur, as well as process information related to the effectiveness of the Application.
3.3. When the User applies for customer support, the Entrepreneur, if necessary, may collect personal information necessary to fulfill the User's request and receive feedback during the operation of his Application. The Entrepreneur may also contact the User using the existing account contact information provided for this purpose.
3.4. The Entrepreneur may collect and store information obtained as a result of surveys that may be conducted by the Entrepreneur or by third-party contractors engaged by him.
Use of personal data
4.1. To provide its services, the Entrepreneur may use the information it collects and places for the following purposes:
4.1.1. providing customer service, including for creating and managing User accounts, solving technical difficulties and accessing various functions;
4.1.2. adaptation of offers and experience, including advertising on its services;
4.1.3. control of general and individual activity of Application Users;
4.1.4. communication with Users, including on matters of service, offering new products and services, maintenance or permitted marketing communications through any available communication channels, etc.;
4.1.5. carrying out research and analytical activities with the aim of improving the Company's services and/or the quality of providing related services;
4.1.6. evaluating certain factors of personal information, in particular, to analyze and predict personal preferences, interests, behavior and location.
4.2. The entrepreneur can keep the information that he collects and receives during the provision of services as long as it is necessary to fulfill the above purposes.
Exchange of information
5.1. The entrepreneur may use third-party providers of the declared service to provide some components of his services. In such cases, providers are not authorized to use personal data obtained as a result of providing services or with the help of the Entrepreneur's Application, other than to provide services to the Entrepreneur, and the personal data themselves are the subject of this Policy.
5.2. The entrepreneur reserves the right, in accordance with the requirements of the law, to provide information to state authorities for the following purposes: fight against fraud and other crimes;
official investigation of violations of the current legislation of the host country or fight against any other violations of the provisions of the Public Contract/Terms of Service.
5.3. The entrepreneur can provide the personal data of the Users at the request of the competent state authorities, issued in accordance with the requirements of the current legislation of the host country.
5.4. For the fulfillment of the specified purposes, the Entrepreneur may transfer data to legal entities whose final beneficiary is the same person who is the final beneficiary of the Entrepreneur.
User control
6.1. Users who create an account through the Application may access, correct or delete the information they provide. The User is responsible for the accuracy of the provided data or messages when using the Entrepreneur's services, services and the Application. The posted information can be changed in the user's personal account in the Application.
6.2. The entrepreneur may delete or stop the processing of the User's personal data upon receipt of the User's written notice of withdrawal of consent to the processing of personal data.
Security
7.1. All information is protected by technical means and security procedures to prevent unauthorized access or use of data. Persons affiliated with the Entrepreneur, reliable partners and independent service providers undertake to use the information received from the Entrepreneur in accordance with the Entrepreneur's security requirements and this Policy.
User rights
8.1. The user has the right to:
a) know about the source of collection, the location of their personal data, the purpose of their processing, the location or place of stay of the owner or controller of personal data or give the appropriate instructions to obtain this information to persons authorized by him, except for cases established by the law of the host country;
b) receive information about the conditions for providing access to personal data, in particular information about third parties to whom his personal data is transferred;
c) to access your personal data;
d) receive no later than thirty calendar days from the date of receipt of the request, except for cases provided by the law of the host country, an answer on whether his personal data is being processed, as well as receive the content of such personal data;
e) present a reasoned demand to the owner of personal data with an objection to the processing of his personal data;
f) make a reasoned demand for the change or destruction of your personal data by any owner and manager of personal data, if these data are processed illegally or are unreliable;
g) to protect your personal data from illegal processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision of data, as well as protection from providing information that is unreliable or dishonors honor, dignity and business reputation natural/legal person;
h) appeal to the court with complaints about the processing of your personal data;
i) apply legal remedies in case of violation of the legislation on the protection of personal data.
Amendments to this Policy
9.1. The entrepreneur can update this Policy, the new version of the Privacy Policy enters into force from the moment it is posted on the Internet at the address specified in this clause, unless otherwise provided by the new version of the Policy. The current edition of the Policy can be found on the page at the address: https://ataka.ua/polityka-konfidentsiynosti/
Final provisions
10.1. The entrepreneur reserves the right to change the Policy in part or in full without guaranteeing the preservation of the favorable terms of the Participant's registration.
10.2. The fact of continuing to use the services of the Entrepreneur and its services is confirmation of the User's consent and acceptance of the relevant version of the Policy.
10.3. The Entrepreneur and the User must choose a sole Arbiter for the parties to resolve the dispute, who will take care of the problems of the Application Users. This document describes the Privacy Policy.
